What type of cases does Cunningham & Mears
handle?
Oklahoma Bar Association ethical rules prevent attorneys from stating
that they specialize in a given field, instead requiring attorneys to state that
their practice is limited to a certain field. At Cunningham & Mears, our
practice is limited to personal injury cases.
The Oklahoma Personal Injury Attorneys at Cunningham & Mears represent injured Oklahomans in four broad areas of injury
law:
- Motor vehicle related accidents
- Premises liability, or slip and fall injuries
|
-
Product liability
-
Workers' Compensation

Personal injury cases are often difficult,
complicated and expensive to pursue. You optimize your chances
for a successful outcome to your case by hiring a personal injury attorney that
focuses on injury cases. If you have been injured, most of your
questions can be quickly answered by one toll-free call to our Oklahoma City personal injury offices. If we
don¹t handle your particular type of injury claim, we will provide you
with a list of qualified local personal injury attorneys that do.
back to top How much is my case worth?
The simple answer is that a personal injury attorney cannot provide an accurate evaluation as
to the value of your case in a telephone consultation. It a personal injury attorney promises
they can obtain some large amount of money for your case without having the
necessary materials to evaluate it, you should have strong reservations about
hiring that personal injury attorney.
The value of your personal injury case is heavily dependent on the nature and extent of your
injuries. However, countless variables will affect the value of your case, such
as: how much damage was done to your vehicle? How did the accident occur? Did
the other party engage in bad conduct such as drunk or reckless driving? What
type and how much insurance coverage is available to pay for your damages? Did
you seek medical treatment near the time of the accident or did you wait a long
time before you saw a doctor?
The list is nearly endless, and there is no set multiplier, such as the urban
myth of three (3) times your medical bills, to determine the value of your case.
By hiring a personal injury attorney early in the process we can present your case in such a
manner to emphasize your case¹s strong points and obtain maximum compensation
for you.
back to top How long will my case take?
If you have a property damage claim, such as damage to your car, those issues
are normally resolved in a matter of days. The duration of your bodily injury
claim is largely dependent on how long it takes for your injuries to heal.
Our Oklahoma personal injury attorneys will begin collecting your medical records and medical bills the same day
you hire Cunningham & Mears. Once you have been released from medical treatment,
we will verify that we have all the relevant medical documentation to present
a settlement offer on your claim.
Personal injury cases have one of two outcomes: Quick or Good. We will only have
one chance to obtain the maximum compensation for your case, and our personal injury attorneys must ensure
that your injuries are resolved before we settle or try your case. Although each
case is unique, generally speaking patience is imperative, and the sooner we
can start work for you, the sooner your case will be resolved in a time frame
and manner that satisfies you.

How much do I pay the personal injury attorney?
Cunningham & Mears will take your case on a contingent fee basis. That means
that you only pay your personal injury attorney if your case has a successful outcome.
If there is no recovery, then you pay Cunningham & Mears nothing. The standard
attorney/client contingent fee amount is 33 and 1/3% of the gross bodily injury
recovery, however this amount may be higher or lower depending on the circumstances
of your case. Unlike other personal injury law firms, Cunningham & Mears
does not take a fee on your property damage recovery or any medical payment proceeds.

The insurance company told me that
if I hired a personal injury attorney, the attorney would take all my money. Is that
true?
Remember, insurance companies are in business to make money, and they do this
by collecting insurance premiums and not paying your claim. The person assigned
to resolve your case is called an insurance adjuster. It is the insurance adjuster¹s
job to see how little he or she can pay for your claim.
If there is any way they can get out of paying your claim altogether, you bet
they will. The insurance adjuster is a trained professional. They deal with dozens
cases like yours everyday, and they usually they have the resources of a multi-billion
dollar corporation at their disposal. In all likelihood, an accident victim has
inadequate training, experience and resources to put up a fair fight with the
adjuster, which is just how the insurance company likes it.
The adjuster doesn¹t want to you to hire a personal injury attorney because you level the
playing field. You will have a trained professional to present your case for
settlement. Our Oklahoma City personal injury attorneys know the value of your case, and if the insurance company
won¹t make a fair offer, we have the experience and resources to protect
your rights in Court.
It is our pledge to all clients that Cunningham & Mears will only take your
case if it will put you in a better position. If you are better off not hiring
an attorney, we will not only tell you that you don¹t need an attorney,
but we will tell you the best way you can handle your case free of charge.

When should I think about hiring
a personal injury attorney?
The answer to this is simple: the sooner the better. The earlier you involve
one of our personal injury attorneys in your case, the better off you will be.
First, you give us the opportunity to preserve evidence and testimony on your
case. Evidence and witnesses have a way of disappearing, and we can¹t travel
back in time to fix problems.
Second, the personal injury attorney¹s fee is set to a contingency on your case, so you
pay based on the final recovery, not the billable hours expended by your personal injury attorney.
There¹s no reason to struggle though your case as your frustration builds
- the sooner you hire one of our personal injury attorneys, the sooner we can lift the
stressful burden of handling your case.
Third, the sooner you have a personal injury attorney, the sooner you will be protected from
calls by the insurance company at home and at work, demanding that you provide
sworn statements, intrusive releases and track down all your medical records
and bills for the insurance company.
Fourth, personal injury cases can be difficult and time consuming. The sooner
we get started, the sooner your case will be settled in manner that satisfies
you.

Why shouldn¹t
I wait and see what the insurance company offers me before
I hire an persona injury attorney?
If your case is not suitable for hiring an attorney, we will let you know right
over the telephone. However, if you case is right for an attorney, the sooner
you hire one, the better your results will be. At Cunningham & Mears, we
believe that early, aggressive case preparation is the keystone of a fair out-of-court
settlement. By preparing your case for trial and showing the insurance company
that we are ready to defend your rights in Court, we increase the likelihood
of a fair out-of-court settlement. If you do not hire a personal injury attorney, you show the
insurance company you are not serious about protecting your rights and you ensure
either poor result and/or a nasty uphill battle in Court. Remember, we only have
one chance to obtain evidence important to your case. We may need photographs
that show damages to property and your injuries. We may need to photograph the
accident scene as it appeared near the time of the accident and to locate valuable
witnesses before they disappear. Early retention of our personal injury attorneys is the
best way to ensure your rights are protected and we can obtain maximum compensation
for your case.
back to top Do I have to
receive medical treatment for my injuries? What if I don¹t
have the time or money to see a doctor?
The value of your case is determined by the nature and extent of your injuries.
If you do not receive any medical treatment, it is usually not possible for your
personal injury attorney to prove your damages to the insurance company, and your case will have
very little value, if any. At Cunningham & Mears, our Oklahoma personal injury attorneys can help you find experienced
physicians that will provide you quality care at a time convenient to you. Even
if you don¹t have health insurance and can¹t afford expensive medical
treatment, we will locate a physician that will provide medical care and bill
directly against your personal injury case.
back to top The insurance company has demanded
that I give them a statement under oath and that I give the access
to all my personal medical and employment information. Do I have
to cooperate with them?
Not if you have a personal injury attorney. If you have an attorney, you can't be compelled
to give a long recorded statement to the insurance company and you don¹t
have to let the insurance company dig through your medical history and talk to
your employer. In most cases, the insurance company¹s right to obtain this
type of information is quite limited. Knowledge is power, and our Oklahoma personal injury attorneys
have the knowledge to guide you through this process while shielding you from
the insurance company¹s attempt to intrude in your life and minimize the
value of your case. Help is just one telephone call away.

I'm not sure that I want to get involved
in a lawsuit; should I still hire a personal injury attorney?
While we approach every case as if it will go to trial, the reality is that over
90% of our personal injury clients receive fair compensation through settlement
negotiations with the insurance company, and a lawsuit is never even filed.
The reasons for our high percentage of out-of-court settlements are our knowledge
of the value of your case, early case preparation and preservation of evidence
and witness testimony. If you show the insurance company that you are up the
challenge of a jury trial on your case, you will probably not be put to the test.
However, if you do not take action necessary to protect your rights, you invite
the insurance company to put you through the gauntlet of the jury trial process.
Although your personal injury attorney will advise whether litigation is appropriate for your
case, only you can decide whether to proceed with a lawsuit against the person
responsible for your injuries.
